Presumably the notary or other party to the transaction would be well within their rights to ask to see a copy of the official marriage certificate or the buku nikah (for Muslims). That's how.

One problem, now you have given half of your land to a stranger. I am lucky as my wife was married before and she shows her KTP (married) and hands over her divorce papers. Lets them know that she has not updated her KTP. If you shopped around you could find a notary that would process the documents providing it was a local land sale.

Could not have said it better myself. If you live in a grey area it pays to push the color code a little and understand as much as you can. NOT blindly adhere to rules and regulations that may change on a daily basis and that are hardly known or understood by those that are asked to enforce them for very little pay.

The problem, as I see it, of dabbling in the grey area in Indonesia is the risk/reward ratio is one sided...to the Indonesian authorities side. There isn't equitable justice for the foreigner. Whilst the gov't/imigrasi/police probably aren't interested they would have to react if a foreigner has a lot of investment in RI and is in the grey area, and makes an enemy. It could be malice, envy, greed or downright vindictiveness but if an Indonesian knows a foreigner isn't complying with Indonesian law the foreigner is vulnerable. It depends on the reward to the risk....inho. I know of some who play the single gal routine to buy Hak Milik property and are now very stressed over the latest pp about needing to live in RI to rent property....as the details of not complying with ownership may become known One of my wife's pals bought Hak Milik land and built a monster house in Canggu (valued in millions USD) and turned it into a mini-resort...she used her maiden KTP to comply with ownership but she has staff (chef, driver, maids, gardener etc.). She cannot fire them in case they report her as they're aware she lives in England and married to a bank executive. Drug dealers, pedophiles, employed without IMTA, overstayed visa...all are in a grey area and until found.... get away. I remember those Aussies, who paid the ultimate price for their reward, were sorry they took the risk.

Or to sum it as one of my friend said "you went to Indonesia, you asked for it" :D But again .. whole life is one big grey area ... sooner or later we all gonna die .. so do not get nervous about trivial things .. I knew a Indonesian muslim girl who went to marry Jew from Izrael ... oh boy .... That was something ! BTW ... Indonesia do not even recognise Izrael or have relationship with it ... (no embasies etc ...) .. talking about "legality" of things ....
