Let me explain my repliesWhen you set up A PMA you are entitled to a resident permit (Kitas) As the owners of the company. This allows you to maintain a office, from there you can check day to day activities. The title director/Komasaris are titles the owner holes to attend to company business (you cannot work).You can live in Indonesia, Kitas as long as you own the PMA, you do not need a work permit as long as you are the owners.If you would like to employ a western person you have to supply a lot of paper work to manpower ie why you need a western person, company accounts etc etc, If you wanted to do the book work for your PMA you would resign as director & the company would need to supply Immigration/manpower with paper work INCLUDING YOUR BA in ACCOUNTANCY. Once you supply all you paper work & the department of manpower issues the PMA with your work permit,you can only work for the company stated on the IMAT.From what you have told us so far, I DO NOT THINK YOU HAVE A VALID IMAT, YOUR LAWYER DOSE NOT THINK YOU HAVE A VALID IMAT.How many more people would you like to tell you that you can not WORK. My wife owns a CV which can not employ western people, so I have a little office out the back because I have a Kitas but no work permit & immigration are fine with that(I don't use agents).I think you are using a agent & the last time i checked they can get you a Kitas & work permit for Rp45,000,000.00 (illegally)THINK you can not own the PMA & have a IMAT.... you cannot be the employer & employee at the same time ???????[/QUOTE]Thank you for taking the time to write this. I was not actually asking about my position, I am the Director of the Company and an employed Director on a salary paying tax, I did submit my MBA in the beginning, my Resume, a job description was done up and I and have a IMAT based on that.I do believe the problem I raised with my husband is that he has a work permit (yet as a Komisaris is not supposed to "work"). So, I rang my lawyer about it today and he was rushing to go off on holidays but mumbled something about the only two positions in the company where we don't have to match the same job with a local is the Komasaris and Director. He said an expatriate resident in Indonesia may not be a director of a PMA company unless he has a work permit sponsored by that company. He said as my husband does not have the qualifications to be a Director (he's a qualified Chef) and he is not working in the full capacity of his qualification but working nonetheless so he needs a work permit, if anyone shows up and he is seen working then he can show he has a work permit, otherwise he cannot be seen in the day to day business. He said when he is next in Bali we will meet and he will explain it, and he made a quick comment that no it does not make sense but there is no other position where he can have a work permit. So, I guess we wait and see, if we can get away with not paying the $1200 per year for his work permit then we will be happy if that is the result, he'll use that on Golf of course, since he can't work.Still wondering if anyone else is in this position? I mean I see owners of bars sit on the patron side of the bar with their laptop so I presume they are pretending they are not working even though we know they are working at least 40 hours a week (with beer in hand).
