Schapelle Corby will know tomorrow if she will be released from the Indonesian jail where she has spent the last nine years. Indonesia's justice minister Amir Syamsuddin has confirmed that he will make a decision on Corby's parole appeal on Friday. The former Gold Coast beauty student was jailed for 20 years in Bali in 2005 after authorities found 4.1 kilograms of marijuana in her bodyboard bag at Denpasar airport the year before. Mr Syamsuddin has told reporters in Jakarta that he has 1,700 cases to sign off on and Corby will not be receiving any special treatment. But he says all the applications will be finalised on Friday. "There are 1,700 inmates that have been processed by the prisons monitoring team (TPP). They all just need a review now," he said. "Corby is just one of that 1,700. She's not a special case. As long as she follows every regulation, and that's based on the TPP recommendation, she has her rights. "I'm about to finish it, but there's no special treatment for anyone. These 1,700 will all be processed together. They all have to be treated fairly, all of them." Corby is hoping to be allowed to serve out the rest of her time at her sister Mercedes' home in Bali, outside Kerobokan jail, where she has been serving her sentence. I tried but couldn't find any reference to the 'proceeds of crime' being applicable to this case. It seemed more to be used to confiscate real property that were abled by crime such as cars, boats, houses etc. Much like the confiscations of those charged in RI for corruption. I would think a book or movie rights would be difficult to relate to this law. As the crime was committed in Indonesia...I also imagine very hard to recover any proceeds and distribute to Australian charities, unless the money was in Australia...can't see that happen!

Thanks spicyayam...I did read the Australian ruling which was applicable to money paid in Australia. Actually, the whole proceeds ($280,000) were transferred to Indonesia prior to the ruling and, in practice, didn't achieve much except freeze McMillan (Australia) from paying any future proceeds on that particular book. I think Australian prosecutors should be smart and go after McMillan ...how much did [B]they[/B] make from the 'proceeds of crime'.

The Act also provides a scheme that allows confiscated funds to be given back to the Australian community in an endeavour to prevent and reduce the harmful effects of crime in Australia.[/B][/I] The Gov't tried to get hold of the money David Hicks got for his book but they eventually dropped the case without explanation. Not sure how SC will go keeping the money she makes. In news just to hand: 200 little Jimmy Olsens were seen heading to various airports around Australia to board flights to Bali. It will be a circus when she gets out.

I say good luck to her. She has been through a pretty rough time, Anyone feeling a bit envious can always buy a few kg of MJ and do the same route as her. and make $2 or 3 million too, if they want to. She didn't have the brains to listen to good advice and nego early on, and ended up paying for it in the long run. :topsy_turvy::topsy_turvy::topsy_turvy:

That was the intention when the legislation was originally passed. They wanted to seize the multi million dollar assets accumulated by crime bosses. Book royalties by Aussies committing crimes in other countries isn't something the legislation catered for which may be why they dropped the case against David Hicks. Hicks for those who aren't aware was an Aussie who spent a few years at Guantanamo Bay. Different circumstances of course in that SC was convicted by a civilian court.

The decision to parole her has not yet been decided. If and when she is...she will need to stay in Bali on a special permit until her full sentence, less the 5 year amnesty granted by President SBY, and other reductions for good behaviour. etc. expires.
