There has been some talk for a while that the road from our village into Kuta (Lombok - sorry but preferred to post in members forum to Lombok forum) is to be widened. In the last few days everyone was contacted and a meeting was held today to explain to the village what is going to happen. They are going to purchase 4.5 metres in from the existing end of the road. For us and all our neighbours, this is not just going to be a loss of land but also of buildings. Most of the houses start within that 4.5 metres. We have been told that for everything, we will pe paid per metre. (but not how much) for the land, for the builings, etc. We will also lose our well and need to dig again (a bigger problem for us than it might sound- having already paid 8 million for a machine bore to do another well and give up before reaching water)
Anyway, I was just wondering if anyone here has had experience of land being brought by the government and what we can expect.

I cannot talk in costs as it is many years since land was aquired for a road project I was on in Sulewesi. There are however different rates of compensation paid regarding the developement and use of the land, its use etc etc.
I Would say however that the compensation paid is at set government rates which never seem to be enough for the land owners. Lets hope the value of having a road matches the improvements you have made to the land.
As an aside I have been fighting for over 25 years to get a proper road to my village as I still have to walk the final 6 Km in the wet season.

Damsiah related a story to me where the government bought back land from a village - the people put in charge were given a price per metre that they would pay - however those people then paid the locals much less and pocketed the difference themselves.
I wonder, when you do get the details of exactly how much land and the compensation offered, whether you should check this with the government office and make sure the offer is correct, or run it by a solicitor? Especially if you are going to be out of pocket.
I'm trying to think which part of your block is being taken back? Is it the 'other side' from the front gates? i.e. the road that goes at the back of your place?

Hi Freo
No it is the front road..... previoulsy we had been told it would be the back road that would be widened. So we loose the brugak/ breakfast room, the well, the money house and a few metres off our parking area, our stone retaining wall, the wall and iron fencing and the front gates.
So I was wondering do they only pay per metre compensation for the part of the buildings that are in the land they buy or for the whole building as it will have to come down and be rebuilt on the upper level. And as for the well.... we you know the problems we have had with water and wells and even a machine bore in other spots has been unable to get to water. Although we are on the mains  too PDAM only turns the water on a few times a week, less in the dry season.

Goodness Mimpi that is terrible. Apart from the potential expense, it is also quite disruptive to your business. And replacing a retaining wall is always tricky too.

I know..... why couldnt it have been the upper level, then we would have been ok except for the kiosk
Well the viallage has their own idea of how much per metre they want but whether we will get that remains to be seen, and personally I doubt it very much, working out what it equates to in costs per are. But who knows..... not much we can do now but wait and see. We should be having someone round in the next few weeks to measure up and give us some figures.
6km in the rain Jimbo??? I dont envy that!

Sorry to hear this. Wish for the best solution to turn out in the end.

Having been told we would probably not be effected, after all. Yesterday we were told that work will start THIS MONTH and that they wil be knocking down our walls and gate,in the fornt and half of our kiosk (just half mind!) at the back! No idea of what compensation will be paid or when. I am really peed of about this. :(

This certainly must be a worry for you Mimpi, i take from your posts you are living mostly in bali now. Might be time time to get some legal advice, especially as there is only ten days left in the month. When you will be compensated and how much is the big questions. Good luck on this one. :?

Made is in Lombok and trying to get more information.

Ok. keep us all posted on how you get on Gemma, this is really quite a big thing to happen, and you thought it had all gone away, only to rear its ugly head again..

First, Sorry to hear this :|
Second, unbelievable
Third, can the government do this? To hum the land (your land) belongs?
Fourth, get some legal advice very quickly, but you have very little time left.
Sorry

Cant they do anything?
Even in UK this happens when roads need to be moved, airports enlarged, Motorways widened.
We cant stop it happening but we just want to make sure we are adequately compensated.

I do agree, but in the Uk you will know well in advance, and well before they start knocking things down, what your compensation will be and also have a chance to negotiate.
For what I’m reading in your posts they will start in 3 weeks time and you haven’t a clue of what you will get.

An update from Made in Lombok -
Work will start this month on the road widening project - In Praya (25kms away) it will be several months before they will reach Kuta.
We will be told our compensation before that time. Someone will be coming to measure up and let us know exactly what we will lose and how much we will be paid.
Made refuses to see a lawyer and prefers to deal with it himself

Sorry to hear this, but it wouldn't be the first time.

Unfortunately, you're probably going to lose.
I live in Bali and am well-acquainted with a story near Ubud, many years ago. The government had "borrowed" some land in a certain village. When it came time for the government to give it back, it didn't.
Of course, the villagers were not impressed. Maybe they're still fighting about it, to this day, in law courts. I wish them luck, if that's the case.
I sure as hell hope things have changed but I wouldn't hold my breath.

There are about 32,000 people in Sidoarjo Java you can talk to about compensation for land.
Completely different circumstances of course, these people lost their land due to an oil drilling disaster and not a planned governmant initiative, dont think too many of them are happy with the deal they got tho'.
Disturbing thing is the company responsible for the drilling disaster was owned by the National minsister for social welfare and disaster relief. Lets hope your council members in Lombok dont follow his terrible example....
