New Rules Issued for Trading via Electronic Systems

According to reporting from Kontan, Minister of Trade Zulkifli Hasan (Zulhas) officially issued new rules for trading via electronic systems (Minister of Trade Regulation (Permendag) number 31 of 2023), which came into effect on 26 September 2023.

Zulhas said that this regulation was an improvement on Minister of Trade Regulation 50/ 2020 concerning business licensing, advertising, guidance and supervision of business actors in trading via electronic systems, adding that the background to the issuance of this regulation included increasing protection for MSMEs, consumers and domestic business actors, as well as to prevent unfair or unfair business competition.

“Governments everywhere throughout the world will certainly protect their domestic MSMEs,” said Zulhas in a press conference on Wednesday (27/09/23.)

Kontan report that some of the main regulations in the new regulations include:

First, defining the business model of trade organizers through electronic systems such as marketplaces and social commerce to facilitate guidance and supervision.

Second, setting a minimum price of USD 100 per unit for finished goods from overseas which are directly sold by traders to Indonesia via cross-border e-commerce platforms.

Third, a positive list is provided, namely a list of goods from abroad that are allowed to cross the border directly into Indonesia via an e-commerce platform.

Fourth, set special conditions for foreign traders in the domestic marketplace. Namely submitting proof of business legality from the country of origin, compliance with standards (mandatory SNI) and halal, inclusion of labels in Indonesian on products from abroad, and the origin of the goods sent.

Fifth, prohibition of marketplaces and social commerce from acting as producers.

Sixth, prohibition of data control by PPMSE and affiliates. PPMSE’s obligation is to ensure that there is no misuse of its user data for use by PPMSE or its affiliated companies.
