    Default Land certificate question

    Hi all,
    Question from my husband if anyone can answer please, most appreciated.
    We are currently looking for some more land and he would like to know if there is any way (like in Aus) if you know the location/address of the land that you can search for the owner details, boundaries, size etc rather than going through searching aroudn the village etc

    BKT is right,
    you would need to go to a notary PPAT, this notary needs to be in the same kabupaten as the land you want to know about.
    this notary has acces to the registery of landcertificates and can research/look up whatever you want to know about it.
    don't read between the lines..i think the words are clear enough...:)

    youd also better check with an independant ( from the landowner )surveyor that the land size is what its meant to be , and have those boundries marked out

    We have just completed a land deal (well nearly... there always seems to be another step!), and my experiance is that the family that own the land often have a photocopy certificate available, in case of disputes with govenment officials, nieghbours, etc. (the original is sometimes found at the Bank held under a Mortage arrangment). If they don't have the 'Sertipikat', then they may not own the land, and you may have met a 'finder' who gets a percentage commission for the introduction to the real land owner.

    We found that the Banjar leader was helpful in pointing out the real owner (they seem to have a financial stake in knowing when land is being sold, etc.).

    However, do make sure that the plan attached to the 'Sertipikat' is actually the one referred to in the documents. Our lawyer pointed out that land offered to us was not the same the land we were interested in buying, and that saved us from a very expensive mistake. The confusion was the plan covered land ownership by the same family, but in different plots. So family name was the same, plot being offered was different.

    Also, find out if the land can be used... we were offered land that was close to a temple (therefore could not be developed). The owner knew, and was waiting for the next 'stupid bule'.

    Good day gents,
    I was looking at buying a villa some time soon, but have started to think about buying some land,and then down the line building my own villa.I have found a nice size plot in Tabanan.But the estate agent say the land comes complete with all certificates and road access and is already re-zoned and ready for develoment ..Can this be true and what should i be looking out for..Pleases any help ..

    Depends on the agent - if its Tabanan it's probably Alasdair and then its probably true, though I've not actually done a deal with him, just looked at dirt with him (so unless anyone knows any different)....
    That said I'd still want to have my own notaris look over the paperwork - there are some very good and valuable threads here (someone should consolidate them into a checklist).
    Of course you'll still have to get the IMB for the villa etc.

    thats what a good notoris is for , to check that everything is as claimed to be and all relevent due dillagence is carried out before any money is handed over to the seller ( the notoris hangs onto the deposit untill everything is cleared ) ...., thats why its in the buyers interest to use a notoris that is independant to the seller .

    note also that commisions (barekarma) are paid by the seller to the broker and not buy the buyer . Most locals prefer this to using a real estate office , which charges a commision anyway .

    It will be a broker who puts a potential buyer in contact with an owner (seller) , who without the broker spruiking the land , a buyer would be none the wiser that it was for sale . The only time brokers are bad news is when they try to give a false(higher ) price to a seller , and in this case they would turn off a potential buyer from a deal , thus missing out on their possible commision ..., these greedy types end up shooting themselves in the foot most of the time while someone honest will usually end up getting the commision from the seller .
