Hello
As I hope to get the retirement visa soon, I am thinking about to change the way of owning my property here in Bali. After reading various statements in this forum and the Internet, I think for me the hak pakai agreement would be just the best way to hold my property.
Here my questions:
1. Is there any problem to change it from my nominee (I hope she will agree)
2. Does anybody know a trustworthy attorney in the Singaraja area?
Tanks
Johann
Hi,
I don't think you will need a lawyer.
Just go to this notary:
Kantor Notaris & PPAT
Farida Andriani SH
Jl. Dewi Sartika 12b
Telp 0362-22926
Singaraja Bali
And ask her.
Below a link to her address on Google Maps:

Hi cmjoe,
depending of the contract between you and your nominee, she/he doesn't have a say in if you choose to change. Most likely if she/he considirs it as a "sale" you would be stuck on paying whatever percentage is agreed upon. If you don't agree with that or forsee any problems, maybe a lawyer/attorney would be a smart way to go, just to be on the safe side.
Since Bert was so nice to give you an adress of a notaris,
Here's another, which services I have used often.
Kantor Notaris/P.P.A.T
I Made Dharma Tanaya, SH
Jalan Ahmad Yani no.90
Telp: 0362-23062 / 26215 Fax: 0362-28909
email:tonnydha@hotmail.com
Hope everything works out for you.
Friendly greetings, Gilbert.
don't read between the lines..i think the words are clear enough...:)
Hello Johann and all
I read with much interest your message since I may be in a similar situation soon. I visited Farida last August (after some forum recomendations) for an initial contact and I plan to meet her again next August. I would appreciate if you could share your impressions about negotiating a Hak Pakai deal with her. Maybe we can meet in my next visit to Bali and share experiences.
Thanks and greetings from Barcelona
Lino
Thank you all for your information. LinoI will let know as soon as I have some own experiences, however this will take some time. Just contact me if you are back to Bali.
Greetings Johann
We will be meeting with the notaris Bert mentioned very very soon. It is good Gilbert is also sharing a name of a notaris.
We have gotten the warning to check if the notaris is trustfull. Well on Bali you never know?!?!
But... if you have suggestions for what to look for in the nominee contracts please let us know very very soon. HOpefully everything will work out fine!
We are, along with an Indonesian, "buying" a property in Bali and it’s past time for us to stop being so naïve and listen to what so many of you have been saying about “owning” property in Bali. We are in the process of “buying” but it isn’t finalized. I am embarrassed to admit that in our meeting with the notaris we could not understand a word of what was said nor can we read the documents we have in hand.
Having searched for “lawyer” on this forum (thousands of posts to read) I’ve found some very helpful information and learned enough to know we’re stumbling blindly in unfamiliar and unsafe territory. I found Rainey Hendriany’s details and also Asia Property Finance’s web page. And now I am thankful to have this thread with recommendations for Farida Andriani and Made Tanaya. Before making a choice can someone tell me whether either or both of these speak very good English? We need to work with someone who can tell us what we’re doing and someone we can trust. Any advice will be well received.
My notaris gave me the contracts in Bahasa Indonesia (which is the only way they are legal in Indonesia) and also gave me the complete contract translated into English. In fact the terms of the contract were initially worked out and dictated in English then translated to Bahasa for registration and legal procedures.
Just something you may want to ask for
I still had to micro manage him but in the end I got a legal contract (long term land lease) and a copy in English .... both signed and notorised.
No matter who you use, you need to be on top of it personally and not just stand back and expect it to be handled like a Solicitor from home.
Regards
N
I understand from Ronb that Farida speaks good english and that is good to know.
Blondie which notaris could you refer to.
And... does anyone have suggestions what to add to a standard contract?
